Release Of Liability & Parent/Guardian’s Agreement/Authorization/Release:

I. I FULLY UNDERSTAND THAT: (a) WATER RELATED ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inactions’ of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my 1 participation or that of the minor in the Activity.

II. I hereby assume all of the risk of participating in swim lessons/practices and acknowledge that the Instructor is not responsible for any injuries resulting from my child or the property owner’s negligence.

III. I also understand that Torpedo Swim School ©, the property owner, and the property manager are not responsible for any damages or loss to person or possession while on the premises. PLEASE READ CAREFULLY. THIS RELEASE OF LIABILITY CONTAINS A RELEASE OF KNOWN AND UNKNOWN CLAIMS BY YOU AND YOUR CHILD. I RECOGNIZE THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING ANY RIGHT I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND ASSIGNS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST Torpedo Swim School ©. I INTEND FOR MY AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY OF Torpedo Swim School © TO THE GREATEST EXTENT PERMITTED BY LAW. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD THIS RELEASE OF LIABILITY, AND KNOWINGLY AND VOLUNTARILY SIGN BELOW:

I acknowledge that photographs or images of myself or my child may be taken during the activity. I provide Torpedo Swim School, along with their affiliates, with unrestricted permission to utilize my/my child's name, photographs, or any other documentation of our participation in this activity in any form of broadcast or other reports related to the activity for promotional purposes, without compensation.

By signing this waiver, I affirm that I have read and understand it and agree with its contents.

1. Application of Florida Law. This Agreement and the interpretations hereof shall be governed exclusively by its terms and by the laws of the State of Florida, without reference to its choice of law provisions.

2. Survival. I agree that my obligations detailed herein shall continue in effect after termination of this Agreement, regardless of the reason, and whether such termination is voluntary or involuntary.

3. Severability. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.

4. Binding Effect. I hereby agree that this Agreement shall be effective and binding on my heirs, next of kin, executors, administrators, successors, representatives, assigns, and/or transferees in the event of my death or incapacity.*

Terms and Conditions

The following sets out those terms and conditions to which you agree to be bound and also provides some information about the Swim School. This is to promote safety and good order, so that swimmers may enjoy a happy and productive experience.

Agreement

All swimming lessons and instructions by Torpedo Swim School (Hereinafter referred to as “TSS”) shall be provided subject to the terms and conditions set out herein. By signing below, you are deemed to represent to TSS that you have full legal capacity to execute this contract, whether for yourself or on behalf of your child/ward; and that you have read, understood, and accepted the terms and conditions set out herein.

General Lesson Policy (Private and Group Classes)

1. All TSS group practices are held at North Port Aquatic Center (6205 W. Price Blvd, North Port, FL 34291)

2. Practice time is primarily scheduled for non-public hours: in the mornings from 8:00 to 10:00 am and (or) in the evenings from 5:00 to 7:00 pm, and these timeframes do not require obtaining facility membership or admission fees.

If TSS practice time is scheduled during public hours, 10:00 am-5:00 pm, membership or admission fees are required for all swimmers and their parents (supervisors, caregivers, etc.) to enter the facility and attend practice.

Also, cases that require purchasing the facility membership or admission fee:
~Swimmers or parents (supervisers, caregivers, etc) want to attend and use the facility before or after TSS 1 scheduled time of practice.
~TSS has designated place and lanes at the pool and usage of the areas of the pool that don't belong to TSS is allowed only if you have the membership or paid admission.

3. All TSS members (parents and their children, coaches, and associates) must follow the Aquatic Center's rules, regulations, and facility management safety instructions.

Training and Schedule Policy

1. TSS conducts practices throughout the year. We may have a two-to-three-week off-season break (typically in August) and several consecutive days off during major holidays.

2. Training days are Tuesday to Saturday.

3. There is no mandatory requirement to visit every practice that TSS provides; however, for consistent skill development in swimming, attendance of at least 75% is strongly recommended.

4. Training groups are established by TSS, based on age, level, parents' availability, and the swimmers' school schedules.

5. There are two major groups:
~ Bubble Jet (Learn to Swim class for very beginners) practicing 15-20 min
~ Spearfish (Swimmers who can swim at least 1000 yards in one practice) duration 70-80 mins. However, the length of the practice may be adjusted based on the current practice's goals.

6. TSS reserves the right to modify, combine, rearrange training groups and times with preliminary notice to facilitate the most consistent attendance and productive training process for swimmers.

7. If, for any reason, swimmers are unable to attend the practice due to a schedule conflict, they may request permission to join an alternative group, provided one is available and suitable for them. TSS reserves the right to make a final decision on this matter, and no swimmers can participate in the alternative group without TSS approval.

8. Swimmers must not enter the water until they have been told to do so. Similarly, they must leave the water when told to do so during or at the end of the practice. Water safety procedures are an essential part of our philosophy. Please encourage your children to observe these guidelines at all times, even when they are not at the TSS.

9. Please control your children while they are on the premises. They are your responsibility before and after the practice. If you came early before the scheduled start time of the practice and your children want to have free time in the water, they can do that only under parents' supervision and lifeguards' permission.

10. Each practice consists of dryland exercises (including preliminary stretching and warm-up before swimming) and an in-water swim workout.

11. Practice may be cancelled due to inclement weather, pool maintenance, or other unforeseen situations. In case of cancellation, it will be announced in the team chat on Telegram.

12. TSS participates in the swim meets (competitions). In order to be eligible to participate in USA-sanctioned swim meets, your child must be registered in USA Swimming.

Discipline/Behavior Policy

I understand that if my child(ren) exhibits behavior that adversely affects the experiences of other children, s/he will be withdrawn from the program and will be responsible for full payment. I understand that TSS will not accept behavior, such as but not limited to, repeated profanity, disrespect, bigotry, bullying, fighting, inappropriate sexual behavior, or any unsafe behaviors that are potentially harmful to my child or to others. I have discussed the policies of TSS with my child so that my child understands that a consequence of unacceptable behavior could be withdrawal from the program. I understand that insubordination and disregard for authority could also lead to training expulsion. I understand that the Head Coach will speak with children and parents once regarding any unacceptable behavior, and if the behavior continues, a student could be withdrawn from the program. I have discussed my expectations for my child in detail and stated that I, as the parent/guardian, and TSS are in agreement.

Fees and Payment Policy

1. Payments for training done monthly.

2. All swim sales are FINAL. After purchasing and booking the designated training month, this slot cannot be switched or changed to another month. I understand that no refunds or adjustments will be made for absences, including but not limited to illness, moving, or other similar circumstances. If TSS finds it necessary to withdraw my child from the program, I will be charged for the full cost of the training month. I understand and agree to accept any losses resulting from my child’s absence for any reason.

3. Monthly payments must be received by the 7th calendar day of each training month or within 3 days after joining TSS or returning to training after a vacation, sickness, or other absence.

4. There are multiple payment methods: Credit card, on-site sale (contactless via Apple Pay or Google Pay), Zelle, Venmo, cash, check, and invoice.

6. Scenarios that give you the right to pay weekly :
~ You have just joined TSS (payment for the remainder of weeks in the current month, prorated)
~ You are a temporary visitor
~ You give one month's notice before your scheduled long-term absence (week or longer)
~ You return to practice after a long-term absence, after more than one week after the beginning of the current calendar month, with preliminary notice.

7. A 10% late fee applies to the monthly payment.

8. If you opt into participation at the meets (competitions), there are additional meet fees that apply, typically it's around $5 per event (distance).

Apparel and Equipment Policy

1. All swimmers 5 years old and older will receive a TSS swim cap upon registration, provided they have signed the TSS waiver and this agreement. Cap replacement is $15.

2. Team apparel is available at the team store https://torpedoswimschool.com/shop

3. Swimmers must wear a TSS cap and a T-shirt when participating in the meet. Team shirt is considered the One with the TSS logo.

4. Swimmers are strongly encouraged to have goggles, a swimsuit (Speedos or jammer for boys and one piece for girls), and one piece swim suit for girls, fins (whole rubber piece, no straps or buckles)

Team Communication

1. All communication, news, updates, short-term notices, etc, is conducted in Torpedo Swim School group on Telegram (invitation needed)

Changes and Updates

TSS reserves the right to alter, amend, or update the terms and conditions stated herein at its sole discretion at any time with prior notice, and all such alterations, amendments, or updates shall be binding on you and/or your child. In the event of any disputes directly or indirectly arising from the terms and conditions stated herein, TSS's decision shall be final and binding.
